What Happens When an Apostille is Rejected? Common Mistakes to Avoid

Apostilles validate documents for use overseas. It is usually a quick and straightforward process, but it is possible that an apostille could be rejected, which can cause stressful delays if you are planning to move, work, study, or marry abroad. Here, we look at what happens when an apostille is rejected and the common mistakes to avoid.

What Happens if an Apostille is Rejected?

If your apostille has been rejected, you will receive a letter that clearly states the reason for the rejection by the Foreign, Commonwealth & Development Office (FCDO) Legalisation Office. You should also receive your original documents and your application form back. This means you are to correct any errors and resubmit the documents and application, which, of course, causes a delay.

Common Mistakes That Lead to Apostille Rejection

Improper notarisation – The document needs to be certified by a solicitor or notary public. If it is not correctly signed, or the signatures do not match, or even if the person who has signed does not have the correct authority, the apostille is not valid. This is why it is important to ensure you use a recognised professional who works strictly to the rules.

Submitting wrong documentation – Not all documents qualify for an apostille. They must be original documents issued by a recognised governmental or judicial body, or an educational setting, or a private document that has been notarised by a public notary. You cannot use a photocopy; it must be an original or a certified copy.

Missing or incorrect information – If you forget to include any relevant information or make mistakes that result in inaccurate information, the apostille cannot be carried out. This also applies if you fail to sign the documents. This is why it is essential to double-check all information before submitting your application.

Payment errors – Sending the wrong payment, not sending payment, or not verifying that the payment has been correctly completed will result in delays and application rejection. Always ensure the correct fee is paid.

How to Ensure Your Apostille Is Accepted

  • Read all required information thoroughly to ensure you have the correct instructions for your application.
  • Ensure the solicitor or notary public is genuine and professional.
  • Make sure you have the correct documentation
  • Make sure your payment is for the correct amount and in the correct form
  • Assemble your documents in the exact order requested by the authority
